Three years in, co-parenting court claims success

In order to disrupt cycles of violence, Milwaukee’s Homicide Review Commission has recommended that Milwaukee police examine how their peers in Rochester, N.Y., organize police work around the concept of preventing disputes from escalating into violence.

Girls Court brings an all-hands-on-deck approach to the lives of vulnerable girls, linking them to social service agencies, providing informal Saturday sessions on everything from body image to legal jargon, and offering a team of adults in whom they can develop trust.

Sacramento County Department of Health and Human Services arose from the need to improve the outcomes of drug addicted parents and their children, such as increasing reunification statistics. STARS employs case workers who have previously been drug addicted, and can provide immediate support and services such as meeting with the participant, accessing treatment options, and drug screening.

A growing number of tribal judges nationwide - including Judge Abby Abinanti of the Yurok Tribal Court - are using a framework of traditional culture and an approach known as "restorative justice" to address both the need for rehabilitation of offenders and resolution for people often failed by the dominant criminal justice system.

In Albuquerque, New Mexico, a domestic violence court offers funnels perpetrators into programs that offer counseling and other services to address the root causes of their behavior. Its two tracks focus on first-time offenders to short-circuit any escalation into chronic abuse, as well as those with multiple domestic violence charges. Judges work closely with participants to encourage them and call them out when they aren't meeting their obligations, and recidivism rates among those who complete the programs are far lower than those who do not.

As the national education discussion has shifted away from zero tolerance discipline policies towards reduction of suspensions and the introduction of restorative justice tactics, some teachers and administrators say the change is happening too fast. Following the elimination of suspensions, at one school in Washington state, each year almost 13 percent of district staff left. Teachers cited lack of training and inconsistencies between standards and implementation in different classrooms as reasons for departing.

Esparanza, a non-profit located in New York, provides comprehensive services for teenagers who are in the justice system. The intensive family counseling has been a successful alternative to incarceration since 2002, and research shows that the approach and other restorative justice practices are well suited for helping children who have been involved with the justice system lead healthy lives.

Brooklyn’s Red Hook Peacemaking Program, part of the Red Hook Community Justice Center, is bringing together individuals in conflict to practice restorative justice. The program accepts cases coming through various courts, schools, and personal references, and brings together families, friends, and adversaries to participate in moderated, peacebuilding discussions. Seeing over 100 cases each year, the program has decreased recidivism rates and spread to other cities in New York.

Philadelphia's Eviction Diversion Program has helped keep more than 400 landlord-tenant disputes out of eviction court proceedings, mainly by using volunteer mediators to work out mutually agreeable plans for tenants to get caught up on their rent payments. The program started in 2020 as a way to keep people housed during the pandemic. By giving landlords and tenants a place to talk out their issues without the expense and repercussions of going to court, and by connecting tenants with rent-assistance aid, the program's launch was successful enough to win an extension throughout 2021.

A new Utah law prevents residents who are more than $2,500 behind on child support payments from obtaining a hunting or fishing license, a strategy lawmakers say provides an incentive without legal ramifications that would affect parents' ability to care for their children in the future. Though the law only applies to a small portion of parents who owe child support, the state saw 494 individuals come into compliance after their hunting and fishing licenses were blocked, with payments increasing by nearly $2 million the year after the new law went into effect.
